As your Brokers, we aim to help you meet the Customs' Modernization Act requirements. In order for us to better serve you, we require accurate and complete information about your merchandise.  Below is a list of potential items that government customs officials may wish to verify.  Note, however, that this list is not necessarily complete.  Additional requirements may arise depending on your merchandise.  Finally, Customs Service makes all final determinations as to duty assessment on any admissibility issues, and will issue written binding advice with respect to any tariff issues. You can request this advice at any time. Contact us for more information on how to address these issues or for any other concerns.
  1. Proper Classification - The importer must provide complete and accurate descriptions and the correct quantity and value of your merchandise, in English.  Reviewing a sample of your product may be helpful in the classification process. Please contact our office if you are not sure how the product should be properly classified, this is the importer's  responsibility, not the broker's.
  2. Valuation - The commercial invoice should give the purchase price, the currency used, and the terms of sale (FOB, CIF, etc.) Customs must be notified of any additional payments made to the seller, buyer, or their agents. Where the merchandise was purchased from a related party, Customs must be notified of this as well.
  3. Country of Origin - All merchandise imported into the U.S., must be marked with the Country of Origin so that the ultimate purchaser or consumer is aware of the origin. This marking should be permanent.
  4. Record Keeping - Records regarding any import  must be maintained for five years. The failure to produce these records in response to a reasonable request from Customs may result in a penalty.
